The idea to fix the norm on the mandatory payment of the 13th salary by employers to employees before the New Year is redundant. This opinion was expressed by member of the State Duma Committee on Labor, Social Policy and Veterans' Affairs Svetlana Bessarab on Tuesday, December 24.
The deputy drew attention to the fact that there are a number of payments of an incentive nature, which are applied by employers of the budgetary and real sector of the economy.
"These are various kinds of bonuses, payments for length of service, for the production of additional products, that is, some kind of preferential, incentive, compensatory payments are provided by collective bargaining agreements," she said in a conversation with Lenta.Ru.
According to the parliamentarian, direct intervention in the activities of organizations is not only pointless, but can lead to the collapse of the economy.
"Just imagine the situation: the employer does not have the means to pay the 13th salary, but under the Labor Code we impose such a payment on him. What will he do? He will minimize all possible incentive payments, bonuses to pay the 13th salary instead - this is at best. And in the worst case, he will simply go bankrupt and will not do business in Russia under such vague and chaotic proposals from the legislators," Bessarab concluded.
Earlier in the day, Sergei Mironov, chairman of the Just Russia - For Truth party, proposed to Russian Prime Minister Mikhail Mishustin the idea of fixing the norm on mandatory payment of the 13th salary by employers before the New Year in the Labor Code, RT reports.
According to him, this measure will increase the motivation of employees, which may affect the increase in labor productivity during the period of staff shortage, 360.ru reports. According to him, additional monetary incentives will greatly help citizens in organizing family vacations and preparing for New Year holidays.
At the same time, Mironov recalled that in practice, companies do not always adhere to the principle of the 13th salary, leaving the decision on payment at their discretion.
Earlier, on December 20, the head of legal practice in SuperJob Alexander Yuzhalin told "Izvestia", who can count on the 13th salary from the employer. The expert explained that in a commercial organization, the size of the bonus should be determined either by the terms of the employment contract or by the terms of a local normative act.
