The Ministry of Economic Development did not support the introduction of a moratorium on bankruptcy of developers

The Ministry of Economic Development of the Russian Federation (Minec) did not support the introduction of a moratorium on bankruptcy of developers until the end of 2025, "Izvestia" has learned.

Earlier, the Ministry of Construction formed a plan to support the construction industry in the Russian Federation, the agencies have prepared their comments on it, the editorial board has familiarized itself with the documents. The resulting contradiction will have to be removed in the government.

"The moratorium is an extraordinary mechanism for responding to unusual circumstances, not a rehabilitation procedure. The moratorium is temporary and does not release debtors from their obligations to creditors," the Ministry of Economic Development emphasized.

The Ministry of Economic Development also noted that a prolonged blocking of forced debt collection procedures may provoke new risks: chains of non-payments and the formation of unfair practice of refusal to fulfill obligations. Moreover, the Ministry of Construction has not presented its calculations, which would prove the effectiveness of the measure, the ministry said.

At the same time, the Ministry of Construction in the table of disagreements noted that it did not take into account such comments in the plan to support the industry.

"The measure proposes the introduction of a moratorium on bankruptcy under conditions similar to the moratorium that was in effect in 2022. It is proposed not to extend its effect to organizations that are developers of apartment buildings and other real estate objects included in the ERPO (unified register of problem objects)," the Ministry of Construction stressed.

If within the framework of the organization's activity it will be revealed that a long blocking of forced collection procedures may lead to the emergence of risks of non-payment chains, such an organization has the right to refuse the application of the moratorium in respect of it, it noted. This is consistent with the law "On Insolvency (bankruptcy) (No. 127-FZ), clarified the Ministry of Construction.

On December 9 it was reported that the Ministry of Construction proposed to introduce a moratorium on bankruptcy of developers until the end of 2025. The document containing this proposal of November 23 was signed by Deputy Head of the Ministry of Construction Yuri Mutsenek. Deputy Prime Minister Marat Khusnullin instructed the Ministry of Construction to work out measures to support the construction industry.
