In Russia, they want to prohibit writing off funds from the sale of debtors' homes


In Russia, they want to ban the write-off of funds from the sale of debtors' housing. As "Izvestia" found out, such a bill has been prepared for introduction by the deputy chairman of the State Duma committee on state building and legislation Anatoly Lisitsyn and the head of the faction "Just Russia - For Truth" Sergey Mironov.
"The bill is developed in connection with the need to protect the constitutional rights to housing of citizens who have enforcement proceedings on credit obligations and are owners of the only housing, which, in turn, is recognized as emergency and subject to demolition in accordance with the procedure established by law," reads the document, which is available at Izvestia.
The document notes that on the basis of part 8 of article 32 of the Housing Code of the Russian Federation in the recognition of residential premises as emergency and subject to demolition, the owner of residential premises by agreement of the parties may be provided with other residential premises in exchange with the offset of the cost in determining the amount of compensation for emergency housing. Thus, from the owner living in the house recognized as emergency and subject to demolition, the residential premises may either be withdrawn by redemption, or he may be provided with other residential premises.
"If the executive authority has no available residential premises for resettlement from the emergency housing stock, the citizen is offered the only option - redemption of residential premises," the document says.
According to Article 24 of the Civil Code of the Russian Federation, a citizen is liable for his obligations with all the property belonging to him, except for the property, which in accordance with the legislation can not be foreclosed, the authors explain.
"Thus, when receiving monetary compensation for the seized residential premises, all those living together with the owner are deprived of the only housing, as well as the possibility of acquiring other residential premises," - stated in the explanatory note to the document.
As explained to "Izvestia" Sergei Mironov, this order of debt collection violates the rights of citizens. Therefore, we propose to introduce a ban on writing off the money received from the redemption of the only (emergency) housing belonging to the debtor.
Earlier, on December 11, it became known that the Ministry of Justice of Russia proposed to introduce restrictions on the actions of collectors of microfinance organizations (MFOs) and banks to connect bailiffs to the collection of debts from citizens within a year after their appearance.
Before that, in June, Evgeny Kvasov, a lawyer of the Consul company, told Izvestia what actions are permissible on the part of collectors and what actions are not. Thus, it is forbidden for collectors to call or write to a debtor without introducing themselves: they must give their full name and the name of the organization they represent. It is forbidden to call at night. Collectors' working hours are from 8 a.m. to 10 p.m. on weekdays and from 9 a.m. to 8 p.m. on weekends, Kvasov said.
