The SF approved the law on fines for debt collection organizations


The Federation Council at its plenary session on December 11 approved a law establishing penalties for microfinance and credit organizations engaged in debt collection on a par with professional collection organizations.
Thus, administrative liability is established for the illegal use by a legal entity in its name of the word combination "professional collection organization". The fine for officials will amount to Br50 thousand, for legal entities - up to Br300 thousand.
For failure to comply with the decision of the Federal Bailiff Service (FSSP) to restrict the use of one or more methods of interaction with the debtor, the amount of the fine will be from Br100 thousand for officials and Br300 thousand for legal entities.
In addition, the law introduces fines for violation of interaction with the debtor. In case of violation, the fine for citizens will be up to Br500 thousand, for officials - up to Br1 million or disqualification for up to a year, legal entities will be obliged to pay a fine of up to Br2 million.
The corresponding bill with amendments to the CAO was prepared by the Ministry of Justice of the Russian Federation back in October last year.
Earlier, on December 11, the Ministry of Justice of Russia proposed to introduce restrictions on the actions of collectors of microfinance organizations (MFOs) and banks to connect bailiffs to the collection of debts from citizens within a year after their appearance.
Prior to that, on November 1, Russian President Vladimir Putin, addressing with congratulations to civil servants, employees and veterans of the Federal Bailiff Service, noted that over the past years the agency has significantly strengthened its potential and increased the effectiveness of its work.
Before that, in June, Evgeny Kvasov, lawyer of the company "Consul", told "Izvestia" what actions are permissible on the part of collectors and what are not. Thus, it is forbidden for collectors to call or write to a debtor without introducing themselves: they must give their full name and the name of the organization they represent. It is forbidden to call at night. Collectors' working hours are from 8 a.m. to 10 p.m. on weekdays and from 9 a.m. to 8 p.m. on weekends, Kvasov said.
