The Russian Ministry of Justice has proposed to impose restrictions on the actions of collectors of microfinance organizations (MFOs) and banks to connect bailiffs to the collection of debts from citizens within a year after their appearance. This was reported on December 11 by RBC, referring to the relevant draft government decree.
The media notes that the agency proposed to postpone the transfer of debts to bailiffs for a year. In addition, their services should become paid for professional collectors. For this purpose it is supposed to amend the specialized law "On the collection of debts of individuals" (230-FZ) and the law "On Enforcement Proceedings" (229-FZ).
This measure is due to the fact that in order to recover overdue debts from citizens, MFIs and banks begin to immediately turn to the powers of the enforcement authorities, instead of using the ways of interaction with the debtor for pre-trial settlement established by law.
Earlier, on November 1, Russian President Vladimir Putin, addressing with congratulations to civil servants, employees and veterans of the Federal Bailiff Service (FSSP) noted that over the past years the agency has significantly strengthened its potential and increased the efficiency of work.
Before that, in June, Evgeny Kvasov, lawyer of the Consul company, told Izvestia what actions are permissible on the part of collectors and what actions are not. Thus, collectors are forbidden to call or write to a debtor without introducing themselves: they must give their full name and the name of the organization they represent. It is forbidden to call at night. Collectors' working hours are from 8 a.m. to 10 p.m. on weekdays and from 9 a.m. to 8 p.m. on weekends, Kvasov said.
