Moscow City Court approved the prosecutor's appeal against the release of the founder of the pharmaceutical company Biotech, ex-senator Boris Shpigel, who was sentenced to 11 years for bribery. About it on Wednesday, December 10, reports the correspondent of "Izvestia" from the courtroom.
It is noted that the prosecutor's office asked to clarify the sentence to Shpigel, indicating that additional punishments should be executed according to the law.
"To specify that he is released from serving a sentence of imprisonment. Additional punishments shall be executed in accordance with the procedure established by law," the court ruled.
The former senator's unexecuted term is seven years. The decision was made due to the serious state of health of Spiegel.
In January 2024, the court sentenced the businessman to 11 years in prison for bribing former Penza Region Governor Ivan Belozertsev. Since his arrest in March 2021, Shpigel has been in the hospital at the Matrosskaya Tishina detention center. The entire trial was held there due to the state of health of the defendant. Doctors prohibited to transport Shpigel to the court.
According to the conclusion of the consilium of the Research Institute of Cardiology dated June 19, 2023 (Izvestiya has it), the patient already had "loss of mobility, sharp limitation of self-care and inability to cope with his functional needs without assistance". In addition, the doctors stated that the patient had an "extremely high risk of developing sudden death."
On November 5, Moscow 's Preobrazhensky Court released the ex-senator from serving his sentence due to his state of health. The same day, his lawyer Zarina Farnieva said that Boris Shpigel would be taken to a medical center after the court decision to release him from serving his sentence. She added that Shpigel was admitted to the pre-trial detention center, already having a number of diseases. According to her, the ex-senator can't move independently and serve himself without the help of third parties.
November 20, it became known that the prosecutor's office filed a complaint against the court decision to release Shpigel. The agency asked to change the decision and specify that additional punishments under the sentence are executed in the manner prescribed by law.
