South Korean police and prosecutors may classify President Yun Seok-yol's actions as "head of the conspirators" in a case of rebellion to seize power and overthrow the constitutional order. Yonhap News Agency reported on Dec. 10.
"As investigative agencies, competing with each other, narrow the radius of the investigation, there is a growing likelihood that President Yoon Seok-yeol's actions will eventually be investigated as the actions of the head of the conspirators in the case of sedition to seize power in accordance with the Criminal Code," the material said.
It is specified that the legislation of the Republic of Korea also allows criminal prosecution of the President in the case of sedition and state treason.
The Criminal Code divides the defendants of this kind of rebellion on the leader of the conspirators, conspirators and key executors. Under the law, the death penalty or life imprisonment is given to those involved, regardless of their status.
Yonhap cites the South Korean prosecutor's office as saying that the president is considered the "most important" in the rebellion, while former state Defense Minister Kim Yong-hyun is considered the key executor. According to the agency, the former head of the republic's defense ministry drafted the decree to impose martial law and ordered troops to be deployed.
The status of a suspect in the case of rebellion against the state system, the prosecutor's office assigned the President the day before. It was reported that law enforcement agencies had launched an investigation into opposition lawmakers' claim that Yoon Seok-yeol had committed treason.
Yun Seok-yeol declared martial law in the country on December 3. He cited the threat of power paralysis caused by attempts to conduct impeachment proceedings as the reason for the move. Commander of the emergency regime, Chief of Staff of the Ground Forces Park Ahn-soo noted that until martial law is lifted in the republic, the activities of the parliament, political parties and associations are prohibited. Military equipment was brought to the streets of Seoul.
The opposition party of the republic, in turn, demanded the resignation of the head of state and said it intended to charge Yoon Seok-yeol with treason. At the same time, all heads and senior secretaries of the presidential administration of South Korea resigned. In addition, the labor unions of the republic announced a general strike.
On December 7, the National Assembly (parliament) of the republic failed to get the necessary number of votes to impeach the president of the country. It takes 200 parliamentary votes to declare impeachment, and only 195 people voted.
Against the backdrop of the order to impose temporary martial law, the South Korean president was banned from leaving the country on Dec. 9. The police also imposed the same ban on former South Korean Interior Minister Lee Sang-min, as well as on former counterintelligence commander of the republic's armed forces Yeo In-hyun and Army Chief of Staff Park Ahn-soo, who was appointed martial law commander.
