Sergei Zakharov, the leader of the Zakharovsky organizedcrime group, hasbeen released from a penal colony in Vladimir, a law enforcement source told Izvestia. The group has been operating in Moscow since 1992 - it was engaged in extortion and kidnapping, covered markets and merchants. Zakharov received his third and so far last sentence - almost 25 years in a strict regime colony - in 2021. But three years later he was released. According to the source, it happened not on parole. Who are "Zakharovsky"

Sergei Zakharov, the leader of one of the most violent criminal groups in Moscow and the Moscow region in the 1990s, a source in law enforcement agencies told Izvestia.

In his criminal biography it was already the third term, but the court included in it and periods for which the authority has already received punishment: one and a half years of imprisonment in 1996-1997, as well as 21-year term served by Zakharov since 2001. Thus, the source emphasized, today's release of Zakharov is not a parole.

From the 1990s to the 2000s, the Zakharovsky organized crime group robbed and roofed businessmen in Moscow, kidnapped and killed people. In particular, the gang actively worked with businessmen from the capital's Danilovsky market - they paid daily for their "roof".

According to the materials of the criminal case, with his associates Zakharov met in one of the gyms near Moscow. Gennady Pushkov, a former physical education teacher, trained the future members of the organized crime group. According to the investigation, at first it was he who led the gang - he was the first to explain to his charges the realities of the new market economy and told them about racketeering as a "good way" to make a living.

In October 1993, under threat of reprisal Pushkov's charges forced a Moscow businessman named Kuzmin to give the criminals an apartment and $37 thousand. The real estate transaction was held in the presence of a notary, according to the case file.

Subsequently, the fame of Pushkov's "fighters" began to spread - they began to be approached by businessmen with a request to extract debts from competitors or "pacify" creditors.

Gradually, the gang's methods of "work" became tougher. The first victim was a businessman named Galkin, whom they tried to convince not to demand $10,000 from the debtor. The businessman was killed, which did not please Pushkov - he told the athletes that they "overreached".

Law enforcement authorities opened a case on the fact of the murder of the businessman and in July 1994 called Pushkov for questioning. There, the former gym teacher testified about Zakharov's involvement in the crime. But the latter was not detained then - the investigation did not have enough evidence. And Pushkov Zakharov ordered to "punish". Two days later, the coach was shot dead.

How evidence against Zakharov was found

In 2001, during a confrontation with Sergei Zakharov, one of the gang members, boxer Alexander Burlakov, testified against him. By that time Burlakov was already in pre-trial detention, and later the court sentenced him to seven years in a penal colony.

The operative video of the bet is in open sources. It shows Zakharov sitting at a table opposite his very sturdy subordinate and with a calm face, almost smiling, recording his testimony in a notebook.

- "Zakharov came up to me and said, 'Sanya, execute Pushkov,'" Burlakov told the investigators. - And he handed me a Makarov pistol with a silencer. I thought: "How could it be? Gennady is our trainer. He taught us, how can I shoot him?" The next day I returned the gun to Zakharov. He told me, "You're a slob and a sissy. I have people who will carry this out."

After Pushkov's death, Zakharov began looking for new people to join the gang and consolidate his power in it. The bandits visited the capital's construction firms and markets. They collected tribute from everyone - $50-100 thousand a month. Sometimes they came into conflict with members of rival organized crime groups. In particular, in September 1995, killers shot in Moscow on Obruchev Street one of the members of the Tagan group, nicknamed Shved, for the fact that he "too impertinent" behaved during the showdown.

It follows from the case file that the bandits had a loyalty oath. Its text Zakharov came up with after Pushkov's "betrayal".

"From now on and to the end, whatever it may be, to follow orders, to act and live by the statute, not to go about their weaknesses. Not to listen to strangers against my own. The enemies of my comrades are my enemies. Before death or under torture, to keep silent about everything that concerns the command. From now until the end, the life of my comrades is my life. And I am responsible for it. I swear it!" - read the text of the oath. The Zakharovs sealed these vows with blood, making incisions on their hands.

In the mid-1990s, Zakharov served a year and a half in prison for weapons possession - this was the only episode on which the court found him guilty in the Galkin murder case. After leaving prison, Zakharov continued his criminal activities. In 1999, the victim of his group was a businessman Maxim Konygin, who was engaged in the sale of petroleum products. As follows from the case materials, at first "Zakharov's" demanded a ransom of $350 thousand for his life, and later killed him. After this murder, there were several more, but the operatives had already followed Zakharov, tapped his phone.

Sergei Zakharov was detained in 2001, and in April 2003, the court found him guilty of banditry, extortion, murder, kidnapping and sentenced him to 21 years of strict regime colony with confiscation of property. In 2019, towards the end of the term, he confessed to involvement in the murder of businessman Konygin and a member of the Tagan OCG Shved and testified against Burlakov. The boxer then stated that all these episodes Zakharov "invented" to take revenge on him.

In 2021, a Moscow City Court jury found Zakharov guilty of organizing the murder of Shved and the elimination of Pushkov, as well as illegal trafficking in weapons. Zakharov received a new, already the third in a row, term - almost 25 years in a strict regime colony.

Aggregation of punishments

In the actions of Zakharov there is a combination of several crimes, and in such cases the final term is appointed by partial or full addition of punishments for each of them, explained "Izvestia" lawyer of the Law Office "Makeev and Partners" Ilya Drozdov.

- In case of partial or full addition of sentences, the maximum term of imprisonment cannot exceed 25 years," the lawyer explained. - New episodes of crimes were committed by him before the previous sentence. And it does not matter that the new circumstances of criminal activity are established after the verdict. In the final term count the sentence served under the first sentence of the court.

After release Zakharov should be administratively supervised, the lawyer reminded. Restrictive measures for particularly dangerous recidivists include a ban on staying in certain places, attending and participating in public events, as well as staying out of the living quarters at certain times of the day. In addition, Zakharov will not be able to travel outside the territory established by the court and will be obliged to report to the supervising authorities within a certain period of time.

Administrative supervision is a measure of coercive-educational nature and is applied only to those persons whose social behavior is fraught with the most real threat of recidivism, added partner of the law firm MILL Daniel Gorkov. At the same time, the establishment and implementation of administrative supervision should not violate other rights and legitimate interests of the supervised person, humiliate his human dignity, compromise at the place of work, study and residence, he said.
