In December, employers have special rules on remuneration for labor. Many companies before the New Year holidays accrue to employees both an advance payment and the main part of the salary in order to comply with the requirements of the legislation. Official advance payment and salary in December 2024: how and when they are paid out

According to the Labor Code of Russia (LC RF), the employer is obliged to charge the employee a salary at least twice a month. At the same time, the break between the advance payment (payment for work for the first half of the month) and the main part of the salary (for work in the second half of the month) should be no more than 15 days. For example, employees can receive money on the 10th and 25th of the month, on the 5th and 20th of the month, etc. The schedule of payments in each company is established separately and is fixed in local normative acts.

If the advance payment or salary falls on a weekend or a non-working holiday, the employer is obliged to pay the employee on the last weekday before this date. It is this rule that affects the December payment schedule, because at the end of the month, Russia celebrates New Year's Eve, followed by a long winter vacation.

In 2024, the New Year holidays will begin on December 29, and Russians will return to work only on January 9 next year, so the advance payment for the last winter month must be paid no later than December 28.

If payment for the second half of December falls on January 1-8, the employer must make the final payment for the month no later than December 28. Thus, the advance payment will come at the usual time, and the main part of the salary - before the winter vacation. The next time the money to the employees' account will arrive in the second half of January.

If the accrual of wages for the second half of December is made on January 9 and later, the schedule of December payments does not change, since these days are already considered working days. However, as noted in the letter of the Ministry of Labor of the Russian Federation, the employer can transfer the entire salary amount in advance. Therefore, some companies also issue salaries for December before the holidays. As a rule, employees are informed about this in advance by e-mail or otherwise.

Salary in January 2025: what payments and when they will come

New Year's holidays also affect the January payment schedule. If the entire salary for December was transferred before December 28, 2024, the next receipt (advance payment) will come only in the second half of January.

When planning the budget for January, it is also worth considering that there are only five working days in the first half of the month, so the January advance will be significantly lower than usual.

To calculate payments, you can use the standard formula: the amount of salary after deducting personal income tax / by the number of working days in the month × by the number of days actually worked. For example, an employee with a salary of 100 thousand rubles after tax deduction will receive an advance payment of 29,411 rubles.

Why Russia lacks leaders

At the same time, the New Year holidays do not give the employer the right to lower the employee's salary. Therefore, in early February, the employee will receive his remuneration for January in full. So, with a salary of Br100 thousand, the second payment will amount to Br70,588.

In January, the peculiarities of payment for business trips and working shifts falling on New Year holidays are also taken into account. Work from December 29 to January 8 is paid at double rate. If desired, the employee can choose a single amount of salary with the provision of time off in proportion to the time worked.

If the employee was on a business trip during the New Year holidays, but did not work, the trip is paid as usual. If he worked during the holidays, he is entitled to double payment for these days. In this case, per diem payments (800 rubles per day) are accrued to the employee for the entire time of the business trip, regardless of what he was doing on holidays.
