FAS issued a prescription to Russian Post for violating the law on competition

"Russian Post" restricted the access of private postal operators to its information system containing information on the possibility of delivering written correspondence in electronic form. This was told on December 3 in the Federal Antimonopoly Service (FAS).

"Now citizens can choose this type of receipt of postal items from the authorities through a single portal of public services. The possibility to check the availability of such consent of the recipient of correspondence has only the information system of JSC "Russian Post"," - explained in the FAS.

As a subject of natural monopoly the company is obliged to provide access to the infrastructure of public postal communications to private operators, having concluded inter-operator exchange agreements with them, the service noted.

"JSC Russian Post abused its dominant position in the market by imposing unfavorable conditions on counterparties. The company did not include in the standard form of the inter-operator exchange contract the service of delivery of written correspondence in electronic form. Thus, alternative postal operators did not have access to information about the subscriber's consent to receive letters in electronic form. According to the agency, such actions infringe on the interests of other postal operators and violate the Law on Protection of Competition", - said the FAS.

Based on the results of the case, the service issued an order to the joint-stock company to eliminate the violation of antimonopoly legislation.

JSC "Russian Post" will be brought to administrative responsibility in accordance with Art. 14.31 of the Code of Administrative Offenses of the Russian Federation.

Earlier, on October 31, the FAS issued an order to mobile operators MTS and Megafon to stop charging additional fees from subscribers in Crimea and Sevastopol. The agency said that back in August it had initiated proceedings against the "Big Three" operators because the companies had failed to fulfill the conditions of earlier warnings requiring them to cancel such fees for subscribers in the republic and the city.

Later, on November 18, MegaFon submitted a notice to the FAS that it had complied with the order and would cancel roaming until February 28, 2025.
