The Dorogomilovsky district court of Moscow has held the first court hearing on the merits of the lawsuit of a victim of botulism against "Samokat. This was reported by Izvestiya correspondent from the courtroom on December 2.

The suit was filed by Nelly Matveeva, the woman demands compensation for moral damage. She refused to announce the amount of the desired payment.

During the court hearing it became known about the intention of "Smart Retail" (brand "Samokat") to conclude an amicable agreement, but the victim was not satisfied with the amount of compensation. The session was postponed to December 18 because of the involvement of a third party in the case - LLC "Lokalkitchen".

According to the woman, two days after consuming the product, she began to feel fatigue. The woman attributed it to overwork, but realized on the street that she had double vision. According to her, she initially attributed the condition to a stroke. At the same time, doctors were unable to diagnose the condition for a long time.

"There were already signs that are everywhere in Telegram-channels, on the radio. <...> Came to work, we began to discuss and realized that it is already botulism for sure," - shared Nelly.

The woman admitted that the cure to the end was not possible - she suffers from severe insomnia, she has recorded cognitive impairment and memory problems. In addition, Matveeva has a serious risk of recurrence of recent cancer.

Izvestia correspondent also took a comment from the victim's defense lawyer Naryk Markarian. He represents Destra Legal law firm, to which three other people have applied with botulism cases. He called Nelly's case the most serious and special, as her health was in a critical condition for a long time, and the woman suffers from the consequences of poisoning even now.

Markarian also pointed out that there are no plans to file a class action lawsuit, and Samokat is trying to resolve the conflict through pre-trial methods.

In June, Rospotrebnadzor launched an investigation after cases of poisoning and suspected botulism in Moscow. The agency determined which companies were engaged in the production and supply of low-quality products and seized almost 200 tons of them. More than 60 tons of this mass was confiscated in Moscow. The head of the agency Anna Popova said that the total number of people infected with botulism amounted to 417 people in several regions of Russia, two died.

All the victims ate salad "Lobio" from the manufacturer LLC "Lokalkitchen na rayon" ("Kitchen on the district") or salad with tuna, apple and beans from "Gastroport". After the mass poisoning, the activities of "Kitchen on the District" and the bean producer "Savon-K" were suspended. A criminal case was opened under Article 238 of the Criminal Code of the Russian Federation ("Provision of services that do not meet the safety requirements for the life and health of consumers").
