Russia has drafted amendments to the law on CMTPL insurance

Insurers will pay for road accidents in the absence of an MTPL policy

The State Duma has prepared amendments to the law on compulsory motor TPL insurance, which envisage changing the rules of compensation payments under the "motor TPL insurance" in cases when the perpetrator of an accident does not have insurance. A copy of the document is at the disposal of "Izvestia" on Friday, November 29.

The law on MTPL is proposed to supplement the chapter, according to which in the absence of a contract of MTPL insurance compensation is carried out by a professional association of insurers.

"In case of realization of such insurance indemnity, the professional association of insurers has the right to a recourse claim for reimbursement of these compensation payments from the person who caused the harm, who did not fulfill the established <...> insurance obligation," the text of the bill says.

Under the current rules, in situations where the perpetrator of the accident does not have a policy of MTPL, compensation is awarded to him from a special compensation fund. In it all insurance companies working with "motor liability", deduct 3% of the insurance premium received from the sale of the policy. However, according to the law on MTPL in this case, only the harm caused to life or health is compensated.

For compensation of expenses on repair of the broken car or other property damaged in the accident, the victims have to turn to the perpetrator of the accident voluntarily or through the court. The bill developed by deputies is designed to change this practice.
