The Ministry of Finance explained the need for out-of-court collection of tax debts from individuals

The Ministry of Finance considers it advisable to introduce amendments according to which tax authorities will be able to collect debts from individuals without a court. Annually, more than 95% (4.5 million) of administrative cases considered by the courts relate to the collection of tax payments, the press service of the ministry told Izvestia.

They added: about 1.1% of them are canceled at the request of the debtor - of this number only the court confirms the legitimacy of collection in 96% of cases. Thus, the statistics shows the expediency of the amendments, the ministry said.

From November next year, the tax authorities will be able to collect debts from individuals without a court - if a person does not challenge the additional charge. Such a bill was prepared by the Ministry of Finance, the government commission approved it on November 25, "Izvestia" found out (the materials are available at the editorial office).

Now tax debts of individuals are collected through the court, said Alexander Zelinko, an expert on tax and civil law disputes of the Russian Bar Association. He specified: control authorities file lawsuits and after receiving a court decision may seize the necessary amount through seizure of bank accounts or imposing restrictions on real estate transactions.

The bill improves the situation of individuals who are not registered as sole proprietors, in case of disputed tax debts, said the Ministry of Finance.

The essence is that if a person disputes the additional charge, this amount will be temporarily excluded from his Unified Tax Account (UTA). This will be in effect until the relevant court decision or until the expiration of a one-month period, the ministry explained.

If the dispute continues, the tax service goes to court to recover this amount, the ministry summarized.
