The decision to pay the 13th salary to employees can only be made by the employer, as this payment is not specified in the Labor Code (LC). Anna Ivanova, a partner of BGP Litigation's labor law practice, told this in an interview with Prime on November 25.

"Although courts often consider monetary claims in favor of employees, but with bonuses the approach is different," she stressed.

Ivanova pointed out that only those to whom they decide to pay the 13th salary have guarantees to pay it. The expert advised to include the condition of payment in the labor contract or in the provision on the system of labor remuneration, explaining the reasons for its issuance.

"Literally 2-3 sentences will help the employer in court, if the employee goes for payment or indexation. After all, the bonus is devoted to just one abstract article in the Labor Code, and if something is not regulated in the company, the court will think it up for her," summarized Ivanova.

Earlier, on November 23, Kremlin spokesman Dmitry Peskov said about the growth of real wages of Russians. According to the Kremlin spokesman, the growth of salaries is a continuous process. In addition, Peskov recalled the current system of allowances for certain categories, including employees and members of the security forces.

November 18, it became known that 70% of companies in Russia in 2024 increased wages. According to experts, most often - in 45% of cases - their increase was due to an increase in salary or salary and bonus at once (41%).
