Lawyer told about compensation for moral damage to victims of road accidents


Victims of road accidents have the right to compensation for moral damages. This was told by lawyer Nijat Muradov on November 24.
"Courts, as a rule, recover compensation for moral harm in cases of injury to health, regardless of its degree. However, the amount of compensation may vary depending on the severity of the harm inflicted. The degree of fault of the person, his behavior after the accident and other factors are also taken into account. For example, the participation of the perpetrator in the rehabilitation of the victim can reduce the amount of compensation", - he explained in conversation with "Gazeta.ru".
According to the expert, moral suffering can be confirmed in several ways. So, you can provide receipts for the services of a psychologist or psychotherapist, proof of attendance at support groups, prescriptions for sedatives, referrals for rehabilitation and other documents. They will help the court to make sure that the accident caused severe mental health consequences.
Muradov also added that the victim has the right to demand reimbursement of both already incurred and future expenses. However, as the expert emphasized, the legislation does not establish fixed amounts of compensation for moral harm, and the court makes a decision based on the circumstances of a particular case.
Earlier, November 13, a teenager in the Tyumen region, who was crushed by a gate at the sports ground in a country camp, was awarded compensation for moral harm in the amount of Br100 thousand. It will be paid by the management of the children's camp.
